This document is a draft and is being reviewed by lawyers. It may change before Vivaham launches.
These terms of use (“Terms”) are an agreement between you and HappyChases Media Works (OPC) Private Limited (“we”, “us”, “our”), a company incorporated in India, which operates Vivaham — the website at vivaham.site and the Vivaham web app (together, the “Service”). Please read them carefully, together with our Privacy policy.
1. Acceptance of terms
By creating an account, joining a family account, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service. If you use the Service on behalf of a family member, you also confirm that you have their permission to do so.
2. Eligibility
2.1 Brides and grooms (profile owners)
A profile may be created only for a person who:
- is a member of a tribe listed as a Scheduled Tribe in at least one state of India — where they live now, and their faith or religion, do not matter;
- is of legal marriageable age under Indian law: at least 21 years old for men and at least 18 years old for women;
- is currently unmarried — never married, divorced, widowed or legally separated — and legally free to marry; and
- is seeking marriage, and gives their own consent to the profile.
2.2 Family members
Each member of a family account must verify their own mobile number, must be a relative of a bride or groom on that account, and must use the Service only to help with their search.
2.3 Verification
A profile is shown to others only after the bride or groom has verified their own mobile number, given consent, and uploaded an ID document whose name and date of birth match the profile. We may refuse, suspend or remove any profile if we cannot verify it.
3. Your declarations
When you create or edit a profile, you declare that:
- the bride or groom intends to marry, and the profile is not being used for dating, friendship, employment, business or any other purpose;
- the marital status, date of birth, tribe, clan and all other details given are true and complete to the best of your knowledge; and
- any ID document uploaded is genuine and belongs to the bride or groom.
Giving false information is a breach of these Terms and may also be an offence under Indian law.
4. Description of the Service
Vivaham helps tribal families find a life partner within their community’s rules. It provides profiles, community filters, recommendations, interests, family group chats, private chats between the bride and groom, and contact exchange.
- Free at launch. The Service is currently free. If we introduce paid features, we will tell you the price and terms before you pay. Any fee will be a charge for using the Service only.
- We are not a marriage broker. We do not arrange marriages, guarantee matches, or act for any family. Decisions about marriage are made by the families and the bride and groom.
- Verification has limits. We check documents and look for warning signs, but we cannot guarantee that every statement made by every member is true. Please meet families in person, with your own family present, and make your own enquiries before any decision.
- We may change, suspend or stop any part of the Service.
5. Family accounts and permissions
- A family account may hold profiles for several brides or grooms and up to 8 members. Each member must use their own login and must not share it.
- Each profile belongs to its bride or groom. Only they can give consent, accept interests, use the private chat, pause, mark as married, hide or delete their profile. They decide what other family members can do on their profile and can remove anyone’s access at any time.
- You are responsible for activity under your own login. Actions on a family account are recorded with the name of the person who took them.
6. Your content
You keep ownership of the content you add — profile details, photos, voice recordings, messages and stories (“Your Content”). You give us a non-exclusive, royalty-free licence to store, process and display Your Content only as needed to provide the Service, in line with your settings and our Privacy policy. This licence ends when Your Content is deleted, except where we must keep records by law. You must have the right to share Your Content, including photos of other people.
7. Intellectual property
The Service, including its design, software, text, logos and the name “Vivaham”, belongs to us or our licensors and is protected by law. You may not copy, modify, distribute or use them except as allowed by these Terms.
8. Prohibited conduct
You must not use the Service to:
- traffic, exploit, or move any person for labour, sex or forced marriage, or recruit anyone for jobs, travel or migration;
- arrange the marriage of anyone below the legal age, or of anyone without their free consent;
- misrepresent yourself or anyone else — including age, marital status, tribe, identity, family, education, job or income — or create fake or duplicate profiles;
- ask for, demand or offer bride price, dowry or any other marriage payment, or act as a broker or agent for such payments;
- harass, threaten, abuse, stalk or pressure any person, or send sexual or obscene content;
- collect, copy or share other members’ personal data, photos or messages outside the Service, or use them for any purpose other than seeking a match;
- ask other members for money, bank details, documents or intimate photos;
- post content that is unlawful, hateful, or that ranks, insults or discriminates against any tribe, community or faith;
- promote any business, product, service or job;
- interfere with the Service — for example by hacking, scraping, using bots, or spreading malware; or
- break any law that applies to you.
We may remove content and suspend or close accounts that break these rules, and we may report suspected trafficking, child marriage or other crimes to the police.
9. Safety, reports and moderation
Our automated systems check profiles, interests and messages, including in family group chats and private chats, for signs of trafficking, fraud and abuse, and our staff review flagged or reported content. You can block or report any member at any time. We may limit features, hide profiles, or suspend accounts while we investigate.
10. Third-party links
The Service may link to websites or services run by others, such as government helplines. We are not responsible for their content or practices.
11. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the extent allowed by law, we make no promises that the Service will be uninterrupted or error-free, that you will find a match, or that information given by other members is accurate. Meeting and marrying another person is your own decision, and you should take sensible care.
12. Limitation of liability
To the extent allowed by law, we are not liable for any indirect or consequential loss, or for the actions, statements or conduct of any member or family, on or off the Service. Our total liability to you for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnification
You agree to compensate us for any loss, claim or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or of another person’s rights.
14. Communications
You agree that we may send you OTPs and service messages — such as new interests, chat notifications, verification results and safety notices — by SMS, WhatsApp, email or in the app, according to your notification choices. These messages never include private content such as chat text, notes or ID details. We will send you marketing messages only if you separately agree, and you can stop them at any time.
15. Termination
- The bride or groom can delete their profile at any time from the profile settings. Family members can leave a family account at any time.
- We may suspend or close an account, or remove a profile, if you break these Terms, if we cannot verify it, if we must do so by law, or to protect the safety of any person.
- Sections that by their nature should continue after termination (including 6, 7, 11, 12, 13, 16 and 17) will continue.
16. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to section 17, the courts at Raipur, Chhattisgarh have exclusive jurisdiction over any dispute relating to these Terms or the Service.
17. Dispute resolution
If you have a dispute with us, please first write to our Grievance Officer so we can try to resolve it informally. If it is not resolved within 30 days, it will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Raipur, Chhattisgarh, and the proceedings will be in English or Hindi. This does not stop either party from seeking urgent relief from a court, or you from using any remedy the law gives you that cannot be waived.
18. Severability
If any part of these Terms is found invalid or unenforceable, the rest will remain in effect.
19. Entire agreement
These Terms, together with our Privacy policy, are the entire agreement between you and us about the Service.
20. Waiver
If we do not enforce any part of these Terms, this is not a waiver of our right to enforce it later.
21. Assignment
You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets, with notice to you.
22. Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, network or power failures, or government action.
23. Changes to these Terms
We may update these Terms. If we make important changes, we will tell you in the app or by message before they take effect. If you continue to use the Service after that, you accept the updated Terms.
